No matter what your status is as an agent – independent or ‘captive’, if you place business with a surplus lines carrier, most states consider it your responsibility to conduct a diligent search of the admitted marketplace before you 'export' the business to the surplus lines marketplace. Regardless of the number of the declinations your state requires, you must typically keep a record of those declinations in your file.

Pennsylvania recently changed the producer's declaration form (1609PR) but not the law. Producers must still obtain at least three declinations from the admitted marketplace. The affidavit you sign states “under penalty of perjury” that you have completed the diligent search process. Don't cut corners - document your file and always return your completed and signed producer's affidavit to Tuscano quickly!
